The psalmist is deeply convinced that God is a reliable addressee to whom those hurt, traumatised and grieving may turn. Churches, by their mandate to share God's loving-kindness, are obliged to provide opportunities, counselling and pastoral care to those who suffer from violations in their lives. Representatives of the church will do so by proclaiming God's compassion and pitifulness. This obligation is all the more important as it can be observed that Christians, congregations and churches have oftentimes been part and (...) parcel of processes that caused harm, hurt and trauma to their members or other people. We consider the time delay of massive, non-relativistic, one-dimensional particles due to a tunneling potential. In this setting the well-known Hartman effect asserts that often the sub-ensemble of particles going through the tunnel seems to cross the tunnel region instantaneously. An obstacle to the utilization of this effect for getting faster signals is the exponential damping by the tunnel, so there seems to be a trade-off between speedup and intensity. In this paper we prove that this trade-off is never in (...) favor of faster signals: the probability for a signal to reach its destination before some deadline is always reduced by the tunnel, for arbitrary incoming states, arbitrary positive and compactly supported tunnel potentials, and arbitrary detectors. More specifically, we show this for several different ways to define “the same incoming state” and “the same detector” when comparing the settings with and without tunnel potential. The arrival time measurements are expressed in the time-covariant approach, but we also allow the detection to be a localization measurement at a later time. (shrink)

This volume has its already distant or1g1n in an inter national conference on Evolutionary Epistemology the editors organized at the University of Ghent in November 1984. This conference aimed to follow up the endeavor started at the ERISS (Epistemologically Relevant Internalist Sociology of Science) conference organized by Don Campbell and Alex Rosen berg at Cazenovia Lake, New York, in June 1981, whilst in jecting the gist of certain current continental intellectual developments into a debate whose focus, we thought, was in (...) danger of being narrowed too much, considering the still underdeveloped state of affairs in the field. Broadly speaking, evolutionary epistemology today con sists of two interrelated, yet qualitatively distinct inves tigative efforts. Both are drawing on Darwinian concepts, which may explain why many people have failed to discriminate them. One is the study of the evolution of the cognitive apparatus of living organisms, which is first and foremost the province of biologists and psychologists (H. C. Plotkin, Ed. , Learning, Development, and Culture: Essays in Evolu tionary Epistemology, New York, Wiley, 1984), although quite a few philosophers - professional or vocational - have also felt the need to express themselves on this vast subject (F. M. Wuketits, Ed. , Conce ts and Approaches in Evolutionary Epistemology, Dordrecht Boston, Reidel, 1984). The other approach deals with the evolution of science, and has been dominated hitherto by (allegedly) 'naturalized' philosophers; no book-length survey of this literature is available at present. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Repetitive thinking predicts and maintains depression and anxiety, yet the role of RT in the perinatal context has been under-researched. Further, the content and themes that emerge during RT in the perinatal period have been minimally investigated. We recruited an online community sample of women who had their first baby within the past 12 months. Participants completed a battery of self-report questionnaires which included four open-ended questions about the content of their RT. Responses to the latter were analyzed using an (...) inductive thematic analysis approach. Participants reported RT about a range of unexpected emotional responses to becoming a new mother, impact on their sleep and cognitive functioning, as well as the impact on their identity, sense of self, lifestyle, achievements, and ability to function. RT was commonly experienced in first-time mothers, and the themes that emerged conveyed an overall sense of discrepancy between expectations and reality, as well as adjustment to profound change. By providing insight into the content of RT in new mothers, the findings of our study have scope to inform the content of interventions that seek to prevent and treat postnatal mental health problems, particularly those which target key psychological processes such as RT. Increasing ethical attention and debate is focusing on whether individuals who take part in clinical trials should be given access to post-trial care. However, the main focus of this debate has been upon drug trials undertaken in low-income settings. To broaden this debate, we report findings from interviews with individuals (n = 24) who participated in a clinical trial of a closed-loop system, which is a medical device under development for people with type 1 diabetes that automatically adjusts blood glucose (...) to help keep it within clinically recommended ranges. Individuals were recruited from UK sites and interviewed following trial close-out, at which point the closed-loop had been withdrawn. While individuals were stoical and accepting of the requirement to return the closed-loop, they also conveyed varying degrees of distress. Many described having relaxed diabetes management practices while using the closed-loop and having become deskilled as a consequence, which made reverting back to pre-trial regimens challenging. Participants also described unanticipated consequences arising from using a closed-loop. As well as deskilling, these included experiencing psychological and emotional benefits that could not be sustained after the closed-loop had been withdrawn and participants reevaluating their pre- and post-trial life in light of having used a closed-loop and now perceiving this life much more negatively. Participants also voiced frustrations about experiencing better blood glucose control using a closed-loop and then having to revert to using what they now saw as antiquated and imprecise self-management tools. We use these findings to argue that ethical debates about post-trial provisioning need to be broadened to consider potential psychological and emotional harms, and not just clinical harms, that may result from withdrawal of investigated treatments. We also suggest that individuals may benefit from information about potential nonclinical harms to help make informed decisions about trial participation. (shrink)

Six papers by theoretical and clinical psychologists, a psychiatrist, and a neurologist, including, in addition to the editors, Seymour Fisher, Herman Witkin, Macdonald Critchley, J. de Ajuriaguerra, and Sidney E. Cleveland. The four middle papers present various findings of clinical psychology on the way in which the individual perceives and identifies with his body. Werner's introduction sets the discussion—albeit sketchily—within the context of recent work in phenomenology on the "body schema" or "body image." Merleau-Ponty is the prime example. In (...) the final paper de Ajuriaguerra returns to the philosophical conclusions which might receive explication and support on the basis of the four middle papers: egological unity is manifested in and mediated through corporeal unity, but in such a way that corporeal unity is not a logically sufficient guarantee of itself and requires an ontological account to ground its characteristic unity—though not necessarily another entity, substantialistic or otherwise. epistemologically, the bogey of psychologism must be rejected in the face of the facts that emerge from the studies in this book and elsewhere: namely, that the perceived world is grasped primordially in relation to the self as necessarily mediated through the body. The implications of this analysis are obviously far-reaching, and the only regret is that they could not be carried out more systematically and extensively in this book.—E. A. R. (shrink)

We all know that ships are safest in the harbor; but alas, that is not what ships are built for. They are destined to leave the harbor and to confront the challenges that are waiting beyond the harbor mole. A similar challenge confronts the practice of research. Research at work cannot play it safe and stay in whatever theoretical and methodological harbors in which it may have found shelter in the past. Still less can it examine and maintain its foundations (...) in the dry dock. Research is more like a ship that must be repaired on the open sea. Yet foundationalist ideas persist in the practice of research. Counter to what is often assumed, today’s dominating model for research--the fallibilist model of critical rationalism--has not really overcome the empirical foundationalism of earlier, positivist research practices. This paper analyses two major foundationalist traps that are currently in the upswing and work against reflective research practice. (shrink)

In this article, we try to clarify some of the issues raised by S. C. Draine, A. G. Greenwald, and M. R. Banaji concerning our investigation into the gender bias in fame judgments . First, we did not test the general hypothesis and did not draw the general conclusion that Drain et al. suggest we did. Second, we did not reject M. R. Banaji and A. G. Greenwald's assumptions about the familiarity of male and female names in the fame judgment (...) task, but we showed how one could have come to reject it using a widespread measurement model for the process dissociation procedure. Third, we argue that the processes which Draine et al. suggest should also be included in the measurement model we used are probably negligible, and if they are not, then the validity of the results of a number of fame judgment experiments must be called into question. In general, however, we agree with what seems to be the main message ofM. R. Banaji and A. G. Greenwald's research, namely, that social categories have to be considered whenever priming is investigated within a social domain. (shrink)

After distinguishing different species of Legal Moralism I outline and defend a modest, positive Legal Moralism, according to which we have good reason to criminalize some type of conduct if it constitutes a public wrong. Some of the central elements of the argument will be: the need to remember that the criminal law is a political, not a moral practice, and therefore that in asking what kinds of conduct we have good reason to criminalize, we must begin not with the (...) entire realm of wrongdoing, but with conduct falling within the public realm of our civic life; the need to look at the different processes of criminalization, and to ask what kinds of consideration can properly figure in those processes; the need to attend to the relationship, and the essential differences, between criminal law and other modes of legal regulation. Readers of the Journal may know little of Melchior Palágyi. Even on the Continent his work has been very inadequately recognized. It is not that he has written little: he published some books and many articles during his lifetime, in German as well as in Magyar, and since his death, Barth of Leipzig has issued an edition of his selected works, including his most important contribution, Naturphilosophische Vorlesungen, also the Wahrnehmungslehre and Zur Weltmechanik. He has many enthusiastic admirers, and those (...) who care to look up the Preussische Jahrbücher, March 1926, will find there a most informative and highly appreciative article on his general philosophy by Werner Deubel, who in the same journal, some two years previously, discussed the work of a kindred spirit, Ludwig Klages. It was Deubel's article that first roused my interest in Palágyi and led me to study his more important writings. (shrink)

How can a system of criminal punishment be justified? In particular can it be justified if the moral demand that we respect each other as autonomous moral agents is taken seriously? Traditional attempts to justify punishment as a deterrent or as retribution fail, but Duff suggests that punishment can be understood as a communicative attempt to bring a wrong-doer to repent her crime. This account is supported by discussions of moral blame, of penance, of the nature of the law's demands, (...) and of the proper meaning and purpose of the criminal process of trial and verdict: it deals both with the ideals that should inform a system of criminal law and the extent to which those ideals are actualised in existing institutions and practices. The conclusion is pessimistic: punishment cannot be justified within our legal system; and this gap between the ideal and the actual presents us with serious moral dilemmas. (shrink)

Aim To study the views of people in a largely Muslim country, Kuwait, of the acceptability of a life-ending action such as physician-assisted suicide (PAS). Method 330 Kuwaiti university students judged the acceptability of PAS in 36 scenarios composed of all combinations of four factors: the patient's age (35, 60 or 85 years); the level of incurability of the illness (completely incurable vs extremely difficult to cure); the type of suffering (extreme physical pain or complete dependence) and the extent to (...) which the patient requests a life-ending procedure, euthanasia or PAS (no request, some form of request, repeated requests). In all scenarios, the patients were women who were receiving the best possible care. The ratings were subjected to cluster analysis and analyses of variance. Results Five clusters were found. For 44%, PAS was always very unacceptable, no matter what the circumstances. For 23%, it was unacceptable, but less so if the patient was older or requested it repeatedly. For 16%, it was unacceptable if the patient was young but was acceptable if the patient was elderly. For 5%, it was unacceptable if the patient had extreme pain but was acceptable if completely dependent. For 11%, it was unacceptable if the patient did not request it but acceptable if she did. Conclusion The majority of the Kuwaiti university students opposed PAS either categorically or with a slight variation according to circumstances. Nonetheless, a minority approved of PAS in some cases, particularly when the patient was elderly. (shrink)

Certainly the most elaborate single extant monument of Renaissance French prose literature, Michel de Montaigne's "Essais" presents a subject matter that often discusses and analyzes concepts of language in general as well as language as a vehicle of its own expression. This study addresses the author's exploration of the dedalus of language as he ambles and rambles its roads, streets, and alleys; draws the portrait of his philosophy of language or philology; and concludes his affirmative and positivistic attitude toward language (...) and its literary application or the art and artistry of literature. The great Renaissance humanist's depiction of language in the "Essais" is analyzed in this book on the basis of its division among intellectual, moral, and aesthetic aspects. This threefold reduction, finding its derivation in the critical work of Aristotle, Auerbach, and Bowen, is also related to the few particular and the important general critical studies of Montaigne and his vision and use, creation and re-creation of language. In this article, we consider two independently appealing theories—the Growing-Block view and Humean Supervenience—and argue that at least one is false. The Growing-Block view is a theory about the nature of time. It says that past and present things exist, while future things do not, and the passage of time consists in new things coming into existence. Humean Supervenience is a theory about the nature of entities like laws, nomological possibility, counterfactuals, dispositions, causation, and chance. It says that none of (...) these entities are fundamental, since if they were, this would entail the existence of irreducible necessary connections between matters of fact. Instead, these entities supervene on a fundamental, non-nomological ‘Humean mosaic’ of property instances at spacetime points. We will further explain and motivate the Growing-Block view and Humean Supervenience in Sects. 2 and 3, but first, we turn to our master argument. (shrink)

Epistemic decision theorists aim to justify Bayesian norms by arguing that these norms further the goal of epistemic accuracy—having beliefs that are as close as possible to the truth. The standard defense of Probabilism appeals to accuracy dominance: for every belief state that violates the probability calculus, there is some probabilistic belief state that is more accurate, come what may. The standard defense of Conditionalization, on the other hand, appeals to expected accuracy: before the evidence is in, one should expect (...) to do better by conditionalizing than by following any other rule. We present a new argument for Conditionalization that appeals to accuracy‐dominance, rather than expected accuracy. Our argument suggests that Conditionalization is a rule of coherence: plans that conflict with Conditionalization don't just prescribe bad responses to the evidence; they also give rise to inconsistent attitudes. Gender discrimination and sexual harassment of female police officers by their male counterparts remain areas of liability where police departments appeared to have failed to effectively confront the nagging issues. However, the appreciable level of research conducted on these issues in the global North has not been matched by the South, where issues bordering on sexual violence have cultural underpinnings. Drawing from the case of the Nigeria Police Force, feminist analysis was used to explore the lived reality of 43 female (...) officers in a qualitative study. Participants expressed distress in abiding by structural discriminatory regulations against female officers which include non-admittance of married women into the force, forbidding unmarried officers from getting pregnant, and a stipulated minimum of three-year work period before a female officer can marry. Findings also indicated that participants suffer a variety of sexual harassment, intimidation, and, violence from their male colleagues, while they feel constrained in reporting their victimization. Important policy and practical implications requiring the Nigerian police to address hegemonic masculinity and promote gender equality were provided. (shrink)

I discuss two problems for the standard Anglo-American account of recklessness, and the distinctions between intention, recklessness, and negligence. One problem concerns the over-breadth of recklessness as thus defined—that it covers agents whose actions display different kinds of culpability. The other problem concerns the importance attached to awareness of risk in distinguishing recklessness from negligence—that one who is unaware of the risk that he takes or creates sometimes displays just the same kind of fault as an advertent risk-taker. We can (...) work towards solutions to these problems by contrasting the Anglo-American schema with the German schema: this distinguishes intention from negligence. Dolus eventualis, properly understood, constitutes a distinctive kind of fault, which should be distinguished from advertent negligence within the category of what the Anglo-American schema counts as recklessness: this helps to solve the first problem, of over-breadth. As for the second problem, we can see why the difference between advertent and inadvertent risk-taking is not always normatively significant by noticing that an agent’s failure to realise the risk he is creating can itself display a significant fault in the structure of the practical reasoning that informs his action—just the same kind of fault as that displayed by an advertent risk-taker. The upshot of this discussion is a new schema of types of criminal fault; I finally note some problems with the practicability of such a new schema. (shrink)

On the basis of a communicative theory of criminal punishment, I show how mercy has a significant but limited role to play in the criminal law—in particular (although not only) in criminal sentencing. Mercy involves an intrusion into the realm of criminal law of values and concerns that are not themselves part of the perspective of criminal law: a merciful sentencer acts beyond the limits of her legal role, on the basis of moral considerations that conflict with the demands of (...) penal justice. Sometimes, however (but in a decent system of law in a decent society, rarely), that is how citizens should act. Finally, I discuss, and criticise, two attempts to find a place for mercy within a communicative conception of punishment, and argue that repentance is not an appropriate ground for leniency or mercy in sentencing. We show that five important elements of the ‘nomological package’— laws, counterfactuals, chances, dispositions, and counterfactuals—needn’t be a problem for the Growing-Block view. We begin with the framework given in Briggs and Forbes (in The real truth about the unreal future. Oxford studies in metaphysics. Oxford University Press, Oxford, 2012 ), and, taking laws as primitive, we show that the Growing-Block view has the resources to provide an account of possibility, and a natural semantics for non-backtracking causal counterfactuals. We show (...) how objective chances might ground a more fine-grained concept of feasibility, and furnished a places in the structure where causation and dispositions might fit. The Growing-Block view, thus understood, provides the resources to explain the close link between modality and tense, so that it predicts modal change as time passes. This account lets us capture not only what the future might hold for us, and also what might have been. (shrink)
